Theresa Trzaskoma

A dedicated advocate for clients in both civil and criminal matters, Allegra represents individuals and businesses in state and federal courts in all stages of litigation, ranging from initial pleadings through trial. She has secured multimillion-dollar judgments, negotiated successful settlements, and won countless motions to dismiss and for summary judgment.

Allegra is an experienced civil litigator, and has a breadth of experience with both commercial litigation and civil rights suits. Allegra’s commercial litigation practice includes business breakups, shareholder disputes, and other matters related to fraud, breach of fiduciary duty, and breach of contract claims. As part of her commercial litigation practice, Allegra advocates for clients both at the trial court level and on appeal, including successful outcomes in federal court, New York state court, and on appeal in the First and Second Departments. Allegra also represents both plaintiffs and defendants in a variety of other civil disputes, including in connection with sexual misconduct allegations, bringing and defending defamation claims, and family court disputes involving orders of protection.

In her civil rights practice, Allegra takes on clients who have been mistreated by federal and state actors, including through Section 1983 litigation, Federal Tort Claims Act litigation, and Article 78 proceedings in state court. Allegra has extensive experience with prisoners rights matters and post-conviction innocence claims. Allegra has also represented multiple clients in federal criminal proceedings, including at trial, at sentencing, and on appeal in the Second Circuit.

  • Secured multimillion dollar recovery for investors defrauded by their investment adviser.
  • Defended Fortune 500 company at multiple federal trials, including a class action litigation and litigation brought by several states and the DOJ.
  • Obtained a multimillion-dollar default judgment after a contested inquest against an executive engaged in a fraudulent kickback scheme to the detriment of health care patients who needed services and did not receive them.
  • Successfully vacated improper foreign arbitration award against business owner in an Article 75 proceeding.
  • Reached a favorable resolution for a former business founder’s valuable ownership interest in the ongoing business.
  • Represented shareholders and managers as both defendants and counterclaimants in business breakup dispute.
  • Represented co-owner of business as defendant and counterclaimant in business breakup dispute.

    Civil Rights Litigation and Other Civil Litigation Matters
  • Defending former Governor Andrew M. Cuomo in multiple high-profile lawsuits.
  • Successfully opposed multiple defense motions for summary judgment and subsequently obtained favorable settlement in § 1983 litigation for client who was assaulted and then denied medical care in New York State custody.
  • Representing three individuals formerly incarcerated at federal Bureau of Prisons facility Big Sandy in connection with their claims arising from misconduct on the part of multiple correction officers.
  • Represented client who maintained his innocence in connection with innocence investigation by the Kings County Conviction Review Unit and in obtaining successful grant of parole.
  • Represented multiple clients, including organizations and individuals, in Article 78 proceedings challenging state action in New York state court.
  • Obtained an order of protection for a client who was the victim of repeated harassment in family court as well as a favorable resolution in a corresponding civil dispute.

  • Secured sentences of time served for multiple defendants in federal criminal proceedings, including defendants charged with passport fraud, drug-related charges, and antitrust violations.
